Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and the operator of FocusLive ("we", "our", or "us"), governing your access to and use of the FocusLive application and related services (the "Service"). By creating an account or using the Service, you confirm that you have read, understood, and agree to these Terms.

If you do not agree to these Terms, you must not use the Service.

You must be at least 13 years of age to use FocusLive. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

To access FocusLive, you must sign in using Google OAuth. By signing in, you agree to provide accurate information and to keep your account secure. You are responsible for all activity that occurs under your account.

You may customise your public profile with a Display Name, Avatar, and Bio. You agree that this public information will not:

• ▸Impersonate another person or entity
• ▸Contain offensive, harassing, or illegal content
• ▸Infringe the intellectual property rights of any third party

We reserve the right to remove or modify profile content that violates these Terms.

4.1 Free Tier

FocusLive offers a free tier with access to core timer functionality and standard features.

4.2 Pro Subscription

Certain features, including access to the Global Focus Map, are available exclusively to Pro subscribers. Pro subscriptions are billed on a recurring basis (monthly or annually, as selected at checkout).

4.3 Payment Processing

All payments are processed securely by Dodo Payments. By subscribing, you agree to Dodo Payments' terms and authorise recurring charges to your payment method. We do not store your payment card details.

4.4 Cancellations and Refunds

You may cancel your Pro subscription at any time. Upon cancellation, you will retain Pro access until the end of your current billing period. We do not offer pro-rata refunds for unused time, except where required by applicable law.

The Global Focus Map displays the approximate live locations of Pro users who have opted in. By enabling this feature:

• ▸You grant us permission to access your device's location via the browser Geolocation API
• ▸You understand your location will be visible to other active map participants
• ▸You acknowledge that your location data is automatically deleted within minutes by an automated process
• ▸You can withdraw consent at any time by disabling location permissions in your browser or toggling off the feature

You agree to use FocusLive only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• ▸Attempt to reverse engineer, decompile, or exploit the Service
• ▸Use automated bots, scripts, or other tools to scrape or manipulate the Service
• ▸Attempt to gain unauthorised access to any part of the Service or its infrastructure
• ▸Upload or transmit malicious code, spam, or any content that is illegal, harmful, or violates any applicable law
• ▸Use the Service to harass, threaten, or harm other users

We reserve the right to suspend or terminate accounts that violate these provisions.

All content, design, code, trademarks, and materials in the Service are owned by or licensed to us and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes.

User-generated content (Display Name, Avatar, Bio) remains your property. By posting this content, you grant us a non-exclusive, royalty-free licence to display and use it in connection with operating the Service.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless FocusLive and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

You may delete your account at any time through the account settings. We may suspend or terminate your access to the Service at our discretion if you violate these Terms, with or without prior notice. Upon termination, your right to use the Service ceases immediately.

Sections 7, 8, 9, 10, and 13 shall survive termination.

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or a prominent in-app notification at least 14 days before changes take effect. Continued use of the Service after changes take effect constitutes your acceptance of the new Terms.

These Terms are governed by and construed in accordance with the laws of the State of Maharashtra, India, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved amicably. If not resolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts located in Maharashtra, India.
